2. Information only — no offer
The Website presents our company and our capabilities for information purposes. Nothing on the Website is a binding offer, and no contract for products or services is formed through the Website. Our services are provided only under a separate written agreement, which takes precedence over these Terms.
3. Intellectual property
The Website and its content — including text, graphics, the Prequant name and logo, design and code — are owned by or licensed to Prequant and are protected by copyright, trademark and other laws. You may view and print pages for your personal or internal business information. Any other copying, reproduction, modification, distribution or public display requires our prior written consent. - run vulnerability scans, penetration tests or load tests against our systems without our prior written authorization (good-faith security reports are welcome — see our Legal notice);
- use automated means to access the Website in a way that places an unreasonable load on our infrastructure;
- use the Website for any unlawful purpose or in violation of these Terms.
5. Third-party websites
The Website contains links to websites of third parties. We do not control and are not responsible for their content, policies or practices. Accessing them is at your own risk.
6. Statements about technology and standards
Descriptions of cryptographic algorithms and standards (for example ML-KEM / FIPS 203, NIST security levels, AES-256-GCM or CNSA 2.0) describe the technology we use. They are not a certification or endorsement by any government agency and are not a guarantee that any system is free of vulnerabilities.
7. Disclaimer of warranties
The Website and all content are provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the Website will be uninterrupted, error-free or free of harmful components, or that its content is complete, accurate or current.
8. Limitation of liability
To the maximum extent permitted by law, Prequant and its members, managers and contractors will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data or goodwill, arising out of or related to your use of the Website. Our total liability for any claim arising out of or related to the Website is limited to one hundred U.S. dollars (US$100).
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for intent or gross negligence, and nothing affects mandatory rights you have as a consumer under the laws of your country of residence.
9. Indemnity
You agree to indemnify and hold Prequant harmless from claims, damages and costs (including reasonable attorneys' fees) arising from your violation of these Terms or your misuse of the Website.
10. Export compliance
Our software and technology may be subject to U.S. export control and sanctions laws, including the Export Administration Regulations. You may not use, export or re-export them in violation of those laws, including to embargoed countries or to persons on U.S. government restricted-party lists.
11. Governing law and venue
These Terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict-of-law rules. The state and federal courts located in the State of Wyoming have exclusive jurisdiction over any dispute arising out of or related to these Terms or the Website, and you consent to their personal jurisdiction. If you are a consumer, you additionally retain any mandatory protection and any right to bring proceedings that the law of your country of residence grants you.
12. Changes
We may change these Terms at any time by posting an updated version on this page. The “Last updated” date shows the current version. Your continued use of the Website after a change means you accept the updated Terms.
13. Miscellaneous
If any provision of these Terms is held invalid, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. These Terms are the entire agreement between you and us regarding the Website (a separate written service agreement governs any services).
